Comedic actor Tracy Morgan is suing Walmart over the deadly limo van crash that left him fighting for his life and seriously injured.  That crash occurred on the New Jersey Turnpike in the early morning hours of June 7. It killed fellow comedian James McNair, who was a close friend of the 45-year-old actor, and injured several others who were riding as a part of Morgan’s entourage.

Walmart’s semi-truck was driven by their employee, Kevin Roper. Investigations determined Roper was driving 20 miles over the speed limit at the time when he rear-ended Morgan’s limo. Roper was also near the end of a lengthy driving shift and is alleged to have been operating his truck recklessly by driving it after going for more than 24 hours without getting any sleep. The suit also claims that Walmart should have known their driver’s sleeping status.

Morgan’s suit includes other plaintiffs and was filed against the retail giant in U.S. District Court in New Jersey on Thursday. Roper plead not guilty last month to criminal charges that included vehicular homicide and assault by vehicle.
