A federal appeals court is questioning whether Obamacare is unconstitutional. The three judge panel in New Orleans heard arguments about whether the Affordable Care Act has lost its legitimacy after Congress removed penalties for the individual mandate that requires people to have health insurance. A lower court in Texas ruled the removal of the fine did invalidate the entire law. The two Republican-appointed judges on the appeals court asked questions that seemed to suggest that the law couldn’t survive if the individual mandate was found unconstitutional. The case will likely go before the U.S. Supreme Court no matter which way the appeals court rules.
