Darrin K. Banks and Brian A. Palmer have been charged with murder and battery by means of a deadly weapon in the March 29th shooting that killed Malaysia Robson and injured her 19-year-old aunt, Ana Fox.

According to Indy Star, Marion County Prosecutor Terry Curry said Tuesday that he would not pursue the death penalty in the case because the suspects did not intend to kill the child. However, if found guilty, the suspects would be eligible for life sentences without parole, Curry said.

More than 20 shots were reportedly fired into the house and Malaysia was reportedly asleep on a couch when bullets tore through the white ranch-style home shortly before 2 a.m. Police have said this all began because of dispute on social media.

Police are also still seeking two women believed to have been in the car the night Malaysia was killed. The women are considered “persons of interest,” authorities told Indy Star.
