Lawyers for Halle Berry and her ex-boyfriend, Gabriel Aubry, are expected in family court Tuesday morning.
The actress’ attorney will try to extend a judge’s order that says Aubrey must stay at least 100 yards away from Berry, their 4-year-old daughter, Nahla, and Berry’s fiancé, Olivier Martinez.
The emergency order, which expires Tuesday, was issued after a brawl between Martinez and Aubry on Thanksgiving Day.
TMZ reports Aubrey, who was dropping Nahla off following a custodial visit, suffered fractured ribs and a bruised face, while Martinez injured his hand and neck.
Both men were taken to Cedars-Sinai Medical Center, but Aubry was later arrested and booked on a misdemeanor battery charge.
He was released after posting $20,000 bail.
Aubry’s lawyers claim 46-year-old Martinez instigated the fight and even threatened to kill the 37-year-old model before slamming his head on concrete.
Aubry filed a restraining order against Martinez on Monday and is expected to be in court to oppose Berry’s request.
A judge is expected to decide whether to extend Aubry’s restraining order against Martinez on Dec. 17.
